
Preemptive Deregulation of AI in the United States

The bill currently under consideration in the U.S. Congress includes a section (43201) that prohibits states and political subdivisions from enforcing any law or regulation on artificial intelligence (AI) models, AI systems, or automated decision systems for a period of 10 years from the date of enactment of the law. Currently, several U.S. states, such as Utah, California, and Colorado, already have regulations on AI, and more than 40 bills are being processed in over a dozen states. These bills would become unenforceable for 10 years if this section is adopted.
